These Terms of Use apply to your use of the website at qballaquatics.com.au and any related pages, content and functionality we provide through it (the Site). The Site is operated by Let's Scape It Pty Ltd trading as Qball Aquatics (ABN 33 635 476 158) (Qball Aquatics, we, us, our).

By accessing or using the Site you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site.

These Terms cover use of the Site only. Any aquarium design, construction, installation or maintenance services we provide are governed by a separate agreement or quotation, not by these Terms.

1. Using the Site

You may use the Site for lawful, personal and non-commercial purposes, including to learn about our work, view our projects and contact us.

You must not:

use the Site in any way that breaches an applicable law or regulation, or that infringes the rights of anyone else;

copy, scrape, harvest, mirror or reproduce any part of the Site or its content, whether manually or by automated means, other than as permitted under these Terms;

attempt to gain unauthorised access to the Site, the server it is hosted on, or any connected system, or interfere with the Site's operation or security;

introduce viruses, malicious code or other harmful material;

use the Site to send unsolicited communications or to collect personal information about others;

misrepresent your identity or your connection with any person or organisation when using the Site or contacting us through it.

We may suspend or restrict access to the Site, or to any part of it, at any time without notice.

2. Our content and intellectual property

Everything on the Site, including text, photographs, video, graphics, logos, aquascape designs, page layouts and underlying code, is owned by or licensed to Qball Aquatics and is protected by Australian and international copyright, trade mark and other intellectual property laws.

"Qball", "Qball Aquatics", "Qball Custom Aquariums", the Q device and the phrase "Water worlds within your walls" are trade marks of Qball Aquatics, whether or not registered.

You may view the Site and print or save individual pages for your own personal, non-commercial reference. You must not otherwise reproduce, publish, distribute, adapt, communicate to the public or commercially exploit any content from the Site without our prior written permission. Photographs and video of our aquascapes in particular may not be reused, reposted or presented as anyone else's work.

Nothing in these Terms transfers any intellectual property rights to you.

3. Information on the Site

The content on the Site is provided for general information and inspiration only. It is not professional advice. Aquariums are living systems and outcomes depend on many factors specific to each installation, including equipment, livestock, water chemistry, lighting and ongoing care. Any descriptions of our process, results or maintenance approach are illustrative and describe our work in general terms. They are not a guarantee of any particular result for you.

Images and video on the Site show real projects we have completed, but colours, plant growth and livestock change over time and may not reflect how an aquarium looks on any given day.

We take reasonable care to keep the Site accurate and current, but we do not warrant that the content is complete, accurate, current or free from error, or that the Site will be available without interruption.

4. Contacting us through the Site

If you contact us through a form on the Site, by email or by phone, you agree to provide accurate information. Sending an enquiry does not create a contract for services. Any engagement will be confirmed separately in writing, together with the terms that apply to it.

Personal information you provide through the Site is handled in accordance with our Privacy Policy.

5. Third party links and embedded content

The Site may include links to third party websites and embedded content from third party platforms, including Instagram, Facebook, TikTok and YouTube. These are provided for convenience. We do not control third party sites or content and are not responsible for their content, availability, privacy practices or terms. A link does not mean we endorse the third party. Your use of third party platforms is subject to their own terms.

6. Australian Consumer Law and liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

Subject to that, and to the maximum extent permitted by law:

the Site and its content are provided "as is" and we exclude all other warranties, whether express or implied, including as to accuracy, fitness for a particular purpose and non-infringement;

we are not liable to you for any loss or damage, however arising (including negligence), in connection with your use of, or inability to use, the Site or any content on it, including indirect or consequential loss, loss of data, or loss of profit or opportunity;

where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant content or paying the cost of having it resupplied.

You agree to indemnify us against any loss, liability or cost we incur arising from your breach of these Terms or your misuse of the Site.

7. Privacy

We collect and handle personal information in accordance with our Privacy Policy, which forms part of these Terms.

8. Changes to the Site and these Terms

We may change, suspend or discontinue any part of the Site at any time. We may also update these Terms from time to time. The current version will always be published on the Site with the date it was last updated. Your continued use of the Site after a change means you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them.

10. General

If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply. A failure by us to enforce any right under these Terms is not a waiver of that right. These Terms, together with the Privacy Policy, are the entire agreement between you and us about your use of the Site.
