This Privacy Policy explains how Let's Scape It Pty Ltd trading as Qball Aquatics (ABN 33 635 476 158) (Qball Aquatics, we, us, our) collects, holds, uses and discloses personal information, and how you can contact us about it.
We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where the Privacy Act does not strictly apply to us, we still follow this Policy as a matter of good practice.
This Policy applies to personal information collected through our website at qballaquatics.com.au (the Site), by email, phone, social media, and in the course of enquiries about and delivery of our aquarium services.
1. What personal information we collect
The kinds of personal information we collect depend on how you interact with us. It may include:
Contact details: your name, email address, phone number and, where relevant, postal or property address.
Enquiry and project information: details you give us about your space, your budget, your interests and what you want from an aquarium; photographs of your home or premises you choose to share; and notes from consultations.
Business details: if you are contacting us on behalf of a business, your role and business contact details.
Communications: the content of emails, messages, form submissions and phone calls with us.
Site usage information: information about how you use the Site, collected automatically through cookies and analytics (see section 5), such as your IP address, device and browser type, pages viewed, time on site and referring site.
Social media interactions: if you interact with us on Instagram, Facebook, TikTok or YouTube, we may see the information your profile makes public and the content of your messages or comments.
We do not ask for sensitive information (such as health information, or racial or ethnic origin) and ask that you do not send it to us. If you do, we will handle it in accordance with this Policy and only for the purpose for which you provided it.
If you do not provide the personal information we ask for, we may not be able to respond to your enquiry or provide our services to you.
2. How we collect personal information
We collect personal information directly from you when you:
submit a form on the Site or email or phone us;
request a quote, consultation or site visit;
engage us to design, build or maintain an aquarium;
follow, message or comment on our social media accounts;
give us a testimonial or permission to photograph or film your aquarium.
We collect Site usage information automatically through cookies and similar technologies.
Occasionally we may receive personal information from third parties, such as a builder, architect, designer or fit-out company who refers you to us, or a client who gives us access to a premises. We will handle that information in accordance with this Policy.
3. Why we collect, hold, use and disclose personal information
We use personal information to:
respond to your enquiries and provide quotes;
design, build, install and maintain aquariums for you, and coordinate with builders, designers and other contractors involved in your project;
schedule visits and maintenance, and communicate with you about your aquarium;
invoice you and manage payments;
keep records of projects, including photographs and video, for our own reference and, with your permission, to showcase our work;
send you information about our services, projects and news that we think will interest you, where you have agreed to receive it or would reasonably expect it (you can opt out at any time);
operate, maintain and improve the Site, and understand how it is used;
comply with our legal obligations and protect our rights.
4. Who we disclose personal information to
We may disclose personal information to:
contractors and trades we work with on your project, such as builders, cabinetmakers, plumbers, electricians and fit-out companies, to the extent needed to complete the work;
service providers who help us run our business, including website hosting, email, cloud storage, customer relationship management, scheduling, accounting and payment providers, and analytics services;
professional advisers such as accountants, lawyers and insurers;
government agencies, regulators or law enforcement where required or authorised by law.
We do not sell personal information.
Some of our service providers store data outside Australia (for example, in the United States or the European Union). Where we disclose personal information overseas we take reasonable steps to ensure it is handled in a way consistent with the Australian Privacy Principles.
5. Cookies and analytics
The Site uses cookies and similar technologies to make it work, to remember your preferences and to understand how visitors use it. We use analytics tools that collect information about your visit in aggregated or de-identified form.
The Site is built on Webflow, which may set cookies necessary for the Site to function. Embedded content from Instagram, Facebook, TikTok and YouTube may set their own cookies and collect information about you according to their own privacy policies.
You can control cookies through your browser settings, including blocking or deleting them. Some parts of the Site may not work properly if cookies are disabled.
6. Photographs and video of your aquarium
Our work is visual, and we photograph and film the aquariums we build, both during construction and once established. Where those images show a private home, identify you, or reveal your location, we will only publish them on the Site or social media with your permission. You can withdraw that permission at any time by contacting us, and we will remove the content from platforms we control within a reasonable time.
7. Marketing
If you have enquired about or used our services, we may send you occasional updates about our work. Every marketing email includes an unsubscribe link, and you can also opt out by contacting us. We will not add you to a marketing list without a reasonable basis to do so, and we do not share your details with third parties for their own marketing.
8. How we hold and protect personal information
We hold personal information in electronic form in email, cloud storage and business systems provided by reputable third parties, and occasionally in paper form. We take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure, including access controls, password protection and secure hosting.
No transmission over the internet is completely secure, and we cannot guarantee the security of information you send to us online.
We keep personal information for as long as it is needed for the purposes described in this Policy, or as required by law (for example, financial records are kept for at least seven years). When it is no longer needed we take reasonable steps to destroy or de-identify it.
9. Accessing and correcting your personal information
You can ask to access the personal information we hold about you, or ask us to correct it, by contacting us using the details below. We will respond within a reasonable time, usually within 30 days. We may need to verify your identity before releasing information. In limited circumstances permitted by law we may refuse access or correction, and if so we will tell you why.

If you have a concern about how we have handled your personal information, please contact us first using the details below. We take complaints seriously and will respond within a reasonable time, usually within 30 days.
If you are not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.
11. Data breaches
If we experience a data breach that is likely to result in serious harm to you, we will notify you and the OAIC in accordance with the Notifiable Data Breaches scheme under the Privacy Act.
12. Third party websites
The Site links to third party websites and social media platforms. This Policy does not apply to those sites. We encourage you to read their privacy policies before providing any personal information.
13. Changes to this Policy
We may update this Policy from time to time. The current version will always be published on the Site with the date it was last updated.
